Seaman Solutions Terms and Conditions

Seaman Solutions is a commercial brand owned by ESEA LEARNING S.A and operated by ESEA BV Belgium. The company adheres to the legislation of Belgium and Panama.

Term 1: Data Protection and Privacy

1.1 Compliance with Data Protection Laws

All Parties, including Seafarers, Particulars, Shipowners, and/or Manning Agencies (collectively referred to as the "Parties"), are obligated to comply with applicable personal data protection laws. Personal, crew, and/or company data may only be submitted to Seaman Solutions or any related entities with the explicit consent of the individual or corporation involved.

1.2 Consent for Use of Data

The Parties must ensure that explicit consent has been obtained for the use and disclosure of personal data in connection with the products and services offered by Seaman Solutions.

1.3 Indemnification

The Parties agree to protect, defend, indemnify, and hold Seaman Solutions, its affiliates, assigns, attorneys, accountants, employees, officers, and directors harmless from any losses, liabilities, claims, damages, or expenses arising from or related to the inaccuracy, non-fulfillment, or breach of personal data protection obligations.

Term 2: Application Processing Time

2.1 Temporary Certification

Subject to the processing times of the relevant Flag State offices, Panama Embassies, or Consulates, a soft copy of the Temporary Certification will generally be issued within one (1) to three (3) working days after payment is received.

2.2 Hard Copy Certification

The issuance of the hard copy of the Temporary Certification is subject to the availability of the relevant Flag State office, Panama Embassy, or Consulate.

Term 3: Purchase Orders and Order Confirmations

All purchase orders issued by you shall specify as a minimum the type and quantity of goods requested, applicable unit prices, delivery place and requested delivery dates. No Purchase order shall be binding on us unless and until confirmed by us in writing.

Term 4: Withdrawal of Applications

Non-Withdrawal Policy: Applications that are in the process of endorsement or provisional status cannot be withdrawn.

Term 5: Refunds

5.1 No Refunds for Rejected Applications

No refunds will be issued if an application is rejected by the General Embassy or Consulate of Panama or its representative for any reason.

5.2 Refund Requests

In case the application has not been submitted to the Flag State Authority, a reimbursement of the total amount will be executed minus a €100 fee for the pre-evaluation service which includes validating and verifying the authenticity of your documents. The applicant must have paid through Stripe; if not, a credit note will be issued. Refunds related to fraudulent or manipulated documents are strictly prohibited, and sanctions may apply.

Term 6: Approval and Rejection of Applications

Discretionary Approval: All approvals and rejections of applications are at the sole discretion of the relevant Flag State office, Consulate, or General Embassy.

Term 7: Charges and Fees

7.1 Subject to Change

All charges are subject to the policies of the relevant Flag State offices, Consulates, or General Embassies and may be adjusted annually.

7.2 Processing Fees

Final charges from Flag State offices, Consulates, or General Embassies include a 30% online processing fee.

7.3 Pre-evaluation Fee

All applicants can request a pre-evaluation to evaluate the chosen rank and documents in the Portal with a fixed cost of €40,00 which will be reimbursed to the applicant(s) from the full seaman book application cost.

7.4 Validation Evaluation Fee

7.4.1

All applicants have the liberty to proceed to payment of their application(s) after uploading the required documents. In case of doubt of the validity of the document(s), we advise all applicants to request a pre-evaluation.

7.4.2

All applications will follow the Seaman Solutions quality management validation process that verifies and validates documents. Should the documents not be valid or deficient, our Operations Team will advise the applicant to obtain the valid document(s) or change of rank.

7.4.3

Should the document(s) appear not to be valid or deficient, and no solution be obtained after advisory of our Operations Team, a reimbursement of the seaman book application cost will be executed minus a fixed cost of €100,00 validation evaluation fee.

Term 8: Mailing Address

Obligation to Update: The Parties are required to keep their mailing addresses updated to ensure the smooth delivery of the hard copy certification.

Term 9: Payment Terms

9.1 Prepayment Requirement

Unless expressly stated otherwise in our order confirmation, payment for goods shall be made 100% prepayment without offset or deduction.

9.2 Payment Default

If you fail to pay any invoice within the agreed period of the due date of payment, we will suspend delivery of any purchase order or any remaining balance.

9.3 Bank Transfer Costs

The Parties shall bear the full cost of bank transfers when making payments to Seaman Solutions.

9.4 Late Payment Fees

Invoice payment is due on receipt. If invoice payments are due on a specific date, the client must comply with payment within the established date. If the client does not comply, the invoice will apply an additional fee as a percentage of the total. If payments are delayed by 10 days, an extra fee of 10% of the total amount will be added. If payments are delayed by 20 days, an extra fee of 20% of the total amount will be added.

Term 10: General Provisions

10.1 Acceptance of Terms

By using this website or the Seaman Solutions portal, you agree to abide by these terms and conditions.

10.2 Right to Amend

Seaman Solutions reserves the right to amend these terms and conditions at any time without prior notice. Users are encouraged to review the terms and conditions periodically.
